LES 3 VALLÉES MOBILE APPLICATION TERMS OF USE

These Terms of Use (hereinafter the “Terms of Use”) set out the rules governing the use of the “Les 3 Vallées” mobile application (hereinafter the “Application”), co-published by:

- The Les 3 Vallées Association (hereinafter “A3V”);

- Its ski area operating companies, hereinafter collectively referred to as the “Operators”:

- Société des 3 Vallées (hereinafter “S3V”);

- Méribel Alpina (hereinafter “Alpina”);

- Société d’Exploitation de la Vallée des Belleville (hereinafter “SEVABEL”);

- Société d’Exploitation des Téléphériques de Tarentaise-Maurienne (hereinafter “SETAM”);

- Société des Téléphériques d’Orelle (hereinafter “STOR”).

Installation of the Application, access to it and its use are subject to your unconditional acceptance of the Terms of Use.

ARTICLE 1. PURPOSE OF THE APPLICATION

The purpose of the Application is to facilitate and enhance your experience during your stay in the Les 3 Vallées ski area and resorts (Courchevel, Méribel Mottaret, Méribel, Brides-les-Bains, Les Menuires, Saint-Martin-de-Belleville, Val Thorens, Orelle). In particular, you may:

- Reload your ski lift pass;

- View the day’s weather, local forecasts, lift openings and lift traffic levels;

- Display your real-time location;

- View the interactive map to locate yourself and explore the ski area;

- Retrieve all photos and videos taken at photo spots;

- Obtain information about nearby points of interest (restaurants, après-ski activities, events, etc.).

A3V and the Operators reserve the right to modify the list and content of the Application’s features at any time and without prior notice.

ARTICLE 2. ACCESS TO THE APPLICATION’S FEATURES

To access the Application’s features, you must:

1. Have a mobile device (smartphone or tablet) running the iOS operating system (iOS version 13 or later) or Android (version 9 or later), and internet access;

2. Download the Application from one of the following websites: “www.les3vallees.com”, or from a mobile application download platform (App Store or Google Play);

3. Accept the Terms of Use;

4. Create your personal account using a valid email address, your last name, first name and a password.

ARTICLE 3. AVAILABILITY OF THE APPLICATION

The Application is available 24 hours a day, 7 days a week, except in cases of force majeure, technical failures and maintenance operations. Maintenance operations may be carried out at any time, without prior notice.

ARTICLE 4. USE OF THE APPLICATION

4.1. General rules

You undertake to:

- Use the Application solely for personal and non-commercial purposes;

- Not sell, rent or commercialise, in any manner whatsoever, all or part of the Application;

- Use the Application exclusively for the purposes for which it is intended;

- Keep confidential and not disclose to any third party the login details (email and password) allowing you to access your personal account;

- Request the generation of a new password in the event that you forget it, its confidentiality is compromised, it is used by a third party, or you suspect or become aware of fraudulent use, by clicking on the “Forgot password?” link accessible on the Application login page. In such case, an email containing a new password will be sent to the address you provided when creating your personal account;

- Not infringe the intellectual property rights of A3V and the Operators in the Application and in its component elements;

- Not use unlawful data or data infringing the rights of third parties, A3V and the Operators reserving the right to delete such data without prior notice and without you being entitled to claim payment of any compensation whatsoever;

- Not commit any act that may compromise the security and confidentiality of the data processed by the Application.

4.2. Specific provisions applicable to certain features

Online sales

The “Ski Pass” feature allows you to purchase your ski lift pass for use in the Les 3 Vallées ski area.

You may access this feature by clicking on the “Ski Pass” button in the menu.

The online sales solution is provided by:

- For Courchevel and Méribel Mottaret: S3V (RCS Chambéry B 429 852 668);

- For Méribel and Brides-les-Bains: Méribel Alpina (RCS Chambéry B 075 520 064);

- For Les Menuires and Saint-Martin-de-Belleville: SEVABEL (RCS Chambéry B 353 065 964);

- For Val Thorens: SETAM (RCS Chambéry B 776 220 584);

- For Orelle: STOR (RCS Chambéry B 402 811 061).

Payment solutions:

- For Courchevel and Méribel Mottaret: Systempay (RCS Paris 493 455 042);

- For Méribel, Brides-les-Bains, Les Menuires and Saint-Martin-de-Belleville: Adyen (RCS Paris B 833 559 479);

- For Val Thorens and Orelle: Payzen (RCS Nîmes B 909 181 968).

ARTICLE 5. INTELLECTUAL PROPERTY

A3V and the Operators are the holders or licensees of the intellectual property rights in the Application and its component elements.

A3V and the Operators grant you a non-exclusive, non-transferable, worldwide, revocable and free licence to use the Application in accordance with its intended purpose.

In particular, you are prohibited from carrying out any copying, extraction, reproduction, adaptation, modification, translation, transcription, arrangement, compilation, decompilation, assembly, disassembly, transcoding, reverse engineering, export, use of source codes or merger of all or part of the Application or its component elements, without the prior and express authorisation of A3V and the Operators.

This licence takes effect upon your acceptance of the Terms of Use and is granted for the duration of protection of the intellectual property rights relating to the Application and its component elements as provided under French law, subject to the provisions of the “Termination” article of the Terms of Use.

ARTICLE 6. PERSONAL DATA

The data concerning you are collected through the Application and are processed under the joint responsibility of A3V and the Operators, respectively represented by Mr Moris GIROLETTI, acting as Director, and whose contact details are indicated in the legal notice.

The personal data collected through the Application are processed for the following purposes:

- Management of your account on the Application. This processing is based on the performance of our general terms and conditions of sale. In this context, completion of the “first name”, “last name”, “email” and “password” fields is necessary to create your personal account;

- Reloading your ski pass. This processing is based on the ski pass sales contract that you enter into with A3V or the Operators;

- Sending satisfaction surveys. This processing is based on the legitimate interest of A3V and the Operators in developing their business;

- Sending newsletters and promotional messages. This processing is based on your consent;

- Processing your location in order to help you find your way and identify nearby points of interest. This processing is based on your consent. In this context, the geolocation of your device is tracked only when you use the Application;

- Securing the Application. This processing is based on the legitimate interest of A3V and the Operators in ensuring the security of your data.

The categories of data collected are as follows:

- Identity and contact data: last name, first name, email, age, etc.;

- Banking data in connection with ski pass reloading;

- Geolocation;

- Data relating to use of the Application for Application security purposes.

The data recipients are:

- A3V and the Operators;

- The processors of A3V and the Operators who act on their behalf in connection with maintenance of the Application, management of your accounts, sending newsletters or hosting your data.

Your data are retained for the following periods:

- Data necessary for managing your account: until deletion of your account or three years after your last contact with A3V or the Operators;

- Data necessary for reloading your ski pass: up to 5 or 10 years from the end of validity of your ski pass, depending on the applicable statutory limitation periods. The number and expiry date of your bank card are retained for a period of 15 months from the transaction for evidentiary purposes in the event of a dispute over the transaction, and to facilitate your subsequent purchases if you have chosen this option. The security code is not retained beyond the transaction;

- Geolocation data: for the time necessary to provide you with the service, namely until deletion of your account;

- Data necessary for sending newsletters, satisfaction surveys and promotional messages: until withdrawal of your consent or 3 years after your last contact with us;

- Data necessary for securing the Application: up to one year after their collection.

You may access the data concerning you, rectify them, request their erasure, exercise your right to restriction of processing of your data or exercise your right to data portability. You may withdraw your consent at any time for processing based on your consent. You may also object to the processing of your data.

If, after contacting us, you consider that your “Information Technology and Civil Liberties” rights are not respected, you may lodge a complaint with the CNIL on its website: https://www.cnil.fr/fr/plaintes.

ARTICLE 7. COOKIES

A cookie is a text file placed on your device when you use the Application. Cookies are managed by the Application. They do not allow you to be personally identified or your personal data to be collected.

The Application generates different types of cookies allowing:

- Statistics on use of the Application to be obtained;

- Our recommendations for activities, restaurants, etc. to be adapted according to, for example, your location.

You may accept or refuse cookies by changing the Application settings. However, if you disable cookies wholly or partially, certain features of the Application may be unavailable.

Please consult the “Help” section of the Application for further information on cookie settings.

ARTICLE 8. FINANCIAL TERMS

Downloading the Application, as well as accessing and using its features, are free of charge, excluding any subscription fees charged by a mobile operator and internet connection fees.

ARTICLE 9. LIMITATION OF LIABILITY

A3V and the Operators shall not be liable, in particular, for:

- Any breach by you of the Terms of Use;

- Any malfunction of the internet network affecting the operation of the Application. In this respect, you declare that you are aware of and accept the characteristics and limitations of the internet network, in particular the functional characteristics and technical performance of the internet network, connection or access issues relating to the internet network, issues relating to network availability and congestion, issues relating to network failure or saturation, issues relating to transit time, access to information made available online, response times for displaying, consulting, querying or otherwise transferring data, risks of interruption, the absence of protection of certain data against possible misappropriation or hacking, risks of contamination by any viruses circulating on such networks, etc.;

- Any malfunction or improper use of your device and any other equipment;

- Any failure, loss, delay or error in data transmission beyond the control of A3V or the Operators;

- Any identity theft of a third party by you.

ARTICLE 10. TERMINATION

You may delete your personal account at any time and free of charge, upon simple request sent to A3V or the Operators using the contact details set out in the “Contact” article below.

A3V and the Operators reserve the right to delete your account without prior notice in the event of any breach by you of the Terms of Use, without you being entitled to claim any compensation whatsoever. A3V and the Operators may exercise this right without prejudice to their right to claim damages as compensation for any loss suffered as a result of your breach of the Terms of Use.

A3V and the Operators also reserve the right to delete your account in the event that operation of the Application is discontinued, without you being entitled to claim any compensation whatsoever.

Deletion of your account entails the concomitant termination of the licence granted to you for use of the Application.

ARTICLE 11. MODIFICATION OF THE TERMS OF USE

The applicable Terms of Use are those in force on the date of your connection to and use of the Application.

A3V and the Operators reserve the right to modify all or part of the Terms of Use at any time and without prior notice. You are informed that a new version of the Terms of Use has been made available online upon your first connection to the Application following such publication. You are invited to read and accept this new version of the Terms of Use. If you do not accept it, you may no longer use the Application.

ARTICLE 13. LANGUAGE

In the event of any discrepancy between the French-language Terms of Use and the Terms of Use in any other language, the French-language Terms of Use shall prevail.
